In such a situation the two parties involved ought to take their argument to a law court where the trial is presided upon by a jury or a judge who will pass their verdict on the issue. The trial lawyer represents their client in various proceedings which include mediation, depositions, settlements, and pre-trial hearings.
The litigation process can be divided into different stages which differ in different cases. The initial steps of the litigation process include investigation, pleadings, and discovery. A pre-trial proceeding is a phase that proceeds after the discovery stage, and then the parties have an option of a settlement or may proceed to a trial. In this litigation process, the discovery phase is the most labor-intensive and time-consuming. The processes involved include the exchange of information through subpoenas, depositions, and interrogations. Depositions and interrogations are the questions posed by the risk of perjury to the parties participating in a lawsuit. The questions in investigations are usually written while those in depositions are posed orally. In many cases in lawsuits, the involved parties often reach an agreement before the case goes to court. A settlement may also be achieved during the trial or after the court’s verdict on the issue.
